Terms of Service for Fort Lauderdale MedSpa

Welcome to The Fort Lauderdale Medspa (“Company,” “we,” “us,” “our”). These Terms of Service (“Terms”) govern your access to and use of thefortlauderdalemedspa.com our online booking and account portals, and our in-person and virtual services (collectively, the “Services”). By accessing or using the Services, you agree to these Terms.

Healthcare Notice: Clinical services may involve Protected Health Information (PHI). PHI is governed by our Notice of Privacy Practices (NPP) under HIPAA. These Terms cover your general site and service use; if there is a conflict between these Terms and the NPP regarding PHI, the NPP controls.

1) Eligibility & Accounts

Age: You must be 18+ (or the age of majority in your state) to use the Services. Minors may receive services only with a parent/guardian present and applicable consents.
Account: You are responsible for maintaining the confidentiality of your login and for all activities under your account.
Accuracy: You agree to provide true, accurate, and complete information, including medical intake details.

2) Non-Emergency; No Medical Advice on the Site

The website content (blogs, posts, FAQs, social media) is informational only and not medical advice.
For emergencies, call 911 or go to the nearest emergency room.
Treatment decisions are made between you and your licensed provider after an appropriate evaluation and informed consent.

3) Appointments, Cancellations, No-Show Policy

Booking: Appointments may require a credit card on file and/or a booking deposit of $50
Cancellations: Cancel or reschedule at least [24/48] hours before your appointment to avoid fees.
Fees: Late cancellations or no-shows may incur a fee of $50 charged to the card on file. Multiple no-shows may result in dismissal from the practice.
Timing: Please arrive [10–15] minutes early for check-in and forms. Late arrivals may be shortened or rescheduled and still subject to fees.

4) Payments, Pricing, and Financing

Payment due at service. We accept [list methods: Visa/Mastercard/AMEX, HSA/FSA where eligible, etc.]
Pricing: We may update prices, promotions, and packages at any time. Quotes are estimates until treatment is completed.
Third-party financing: If you apply for financing (e.g., [Cherry/CareCredit/etc.]), their terms and privacy policy apply.
Tips/Gratuities: [Optional/Not accepted], at your discretion.
Refunds: See Section 5.

5) Results, Revisions, and Refunds

Results vary. Aesthetic outcomes depend on individual anatomy and aftercare; no outcome is guaranteed.
Medical services are generally non-refundable. Once a treatment is rendered or a prescription issued/dispensed, fees are not refundable.
Packages & prepaid: Unused package sessions may be non-transferable and expire after 12 months. Administrative fees may apply to permitted reversals consistent with law.
Retail products: Unopened, unused products may be returned within 30 days with receipt; opened skincare may be exchanged for store credit at our discretion.

6) Memberships & Subscriptions

Enrollment: By joining Memberships, you authorize recurring monthly charges to your card on file until cancellation.
Banked funds: If applicable, banked funds can be used for [eligible services] and expire after 12 months. Banked funds have no cash value and are non-refundable, except as required by law.
Changes: We may modify benefits, pricing, or terms on 30 days’ notice.
Cancel anytime: Cancel with 90 days’ notice before your next billing date. You are responsible for any balances or used benefits.

7) Gift Cards, Promotions, and Referrals

Gift cards are redeemable for services/products, not cash, and subject to state law on expiration.
Promotions cannot be combined unless stated. We may modify or end promotions at any time.
Referral rewards (if offered) are issued after the referred person completes a qualifying service; limits may apply.

8) Telehealth & Remote Services

You may be offered telehealth via secure platforms. You consent to receive care electronically and to the limitations of remote evaluation. You may withdraw consent at any time and seek in-person care.
You are responsible for a private environment and reliable internet. Recording visits is prohibited unless all parties agree in writing.

9) User Conduct

You agree not to:

Interfere with the site, attempt to bypass security, or use automated scraping.
Post or transmit unlawful, harassing, defamatory, or infringing content.
Upload content you do not own or have rights to share.
Record or photograph staff or other clients without permission.

We may suspend or terminate access for violations.

10) Intellectual Property

The site, logos, photos, videos, before/after images, text, and other materials are owned by us or our licensors and protected by IP laws.
You may use the site for personal, noncommercial purposes only. No reproduction, distribution, or derivative works without prior written consent.

11) Testimonials, Photos, and User-Generated Content

You may submit reviews, testimonials, photos, or comments (“UGC”). You grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, and display your UGC in any media for marketing, subject to any separate HIPAA-compliant media consent you sign for identifiable images/PHI.
We may edit or remove UGC that violates these Terms or applicable law.

12) Communications; SMS & Email Marketing

By providing your phone or email, you consent to receive transactional communications (e.g., confirmations, reminders).
With your consent (where required), you may receive marketing texts/emails.
Opt-out: Reply STOP to texts or use the unsubscribe link in emails. Message/data rates may apply.
Recording/quality: Calls or messages may be recorded for training/quality where permitted by law.

13) Privacy

Your use of the Services is also governed by our Privacy Policy and, for PHI, our Notice of Privacy Practices.

14) Third-Party Services & Links

We use third parties for hosting, booking, payments, telehealth, analytics, and advertising. Their terms and privacy policies govern your use of their tools. We are not responsible for third-party content or practices.

15) Contraindications; Aftercare & Compliance

You agree to disclose complete and accurate medical history, medications, allergies, and prior treatments.
You agree to follow all pre- and post-care instructions. Complications can arise if instructions are not followed.

16) Disclaimers

THE SERVICES AND SITE CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not guarantee uninterrupted or error-free operation of the site.

17) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES OR SITE, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID FOR THE SERVICE GIVING RISE TO THE CLAIM IN THE 12 MONTHS BEFORE THE EVENT OR (B) $250. SOME STATES DO NOT ALLOW CERTAIN LIMITATIONS; THESE MAY NOT APPLY TO YOU.

18) Indemnification

You agree to defend, indemnify, and hold us harmless from any claims, damages, costs, and expenses (including reasonable attorneys’ fees) arising from your violation of these Terms, your UGC, or your misuse of the Services.

19) Dispute Resolution; Arbitration; Class Action Waiver

Please read carefully:

Arbitration: Except for small claims or injunctive relief for IP/Confidentiality, any dispute arising out of or related to these Terms will be resolved by binding arbitration administered by [JAMS/AAA] under its [consumer/commercial] rules.
Venue & Governing Law: These Terms are governed by the laws of the State of [Florida], without regard to conflicts principles. Arbitration seat and venue: [Broward County, Florida].
Class/Representative Actions Waiver: Disputes must be brought individually; no class, consolidated, or representative actions.
Jury Trial Waiver: To the extent permitted by law, you waive the right to a jury trial.
Consumers may have non-waivable rights under state law; this section applies to the fullest extent permitted.

(If you serve many California consumers, ask counsel whether to present an opt-out or alternative dispute path.)

20) Termination

We may suspend or terminate access to the site or refuse service for any reason not prohibited by law, including safety concerns, abusive behavior, or policy violations. You may stop using the Services at any time; Sections that by nature should survive will survive (e.g., IP, disclaimers, limitations, indemnity, dispute resolution).

21) Changes to the Services or Terms

We may modify the Services or these Terms at any time. The “Effective Date” above reflects the latest revision. Continued use signifies acceptance of the updated Terms.

22) Miscellaneous

Severability: If a provision is unenforceable, the remainder stays in effect.
Entire Agreement: These Terms, the Privacy Policy, NPP, consent forms, and any service-specific addenda are the entire agreement between you and us.
No Waiver: Our failure to enforce a provision is not a waiver.
Assignment: You may not assign your rights without our consent; we may assign to an affiliate or in connection with a business transfer.
Force Majeure: We are not liable for delays or failures beyond our reasonable control (e.g., outages, epidemics, supply disruptions).
